Anybody know the section of the fire code in Los Angeles that covers fire performance? Specifically, are there sections that cover what I can do in my home that I own? We have a nosey neighbor who called the fire dept after our friend was spinning fire in our back yard for all of five minutes. Do I need a permit to spin at my own home? If so, can I get one that extends for weeks or do I have to get one for each time? Any help would be appreciated.

Mon, May 5, 2008 - 11:54 PMThe only important part is that more than 10 "friends" constitutes an audience (though there is a little wiggle room for about 10 more people). With an "audience" the normal rules apply: get a permit, 15' clearance, no class I fuels, etc.

I don't want to antagonize the fire dept and plan to walk up to talk with them. But the rules that fire performers have to follow would seem to be different than those for a home owning fire spinner in his own back yard. -

Fri, May 16, 2008 - 1:42 PMStudio City is part of the 2nd City Council District of Los Angeles. AKA Los Angles City proper. I don't think the Fire Dept cares if a fire hazard is posed by the homeowner or his guest, so I'd not count on that as a loophole.

Fri, May 16, 2008 - 6:02 PMChris, yes, you are in LA City Jurisdiction. You and up to 10 guests (or so) can spin fire at any time, legally, without permit or notice.
If a policeman should notice more than 10-15 people at your place in a "cabaret-like atmosphere", or are charged money at the door, they can decide that it is a 'public event' under the cabaret laws and use the fire (specifically the lack of permits) as an excuse to shut down the event. This is very rare on private property, and usually noise ordinances are the cited reason. Tickets can also be issued, but in my 10 years or so on the scene, I've only ever heard of one getting written for public endangerment, but that was at a public beach and someone got lippy.

So, if Chris is at the party palace spinning poi over by the pool, are you saying he needs a permit if Salad and nine hippies are watching him? -

Sat, May 17, 2008 - 6:43 PMAgain, there's some wiggle room in the specific numbers. But I'd take every opportunity to get in some practice when fewer than 10 people around. There's no party to break up and if the FD shows up, you can ask them to cite the specific laws involved. Chances are they'll resort to the "just be nice to your neighbors" stance. -

I've actually never had a problem at my place, im on an acre lot so plenty of room, but i did have a neighbor call the cops at one of our Thursday jams at a friends.
*cop looks over the wall and sees a bunch of people talking and a small oil lamp sitting on the ground near a pool.*
"We heard you guys are making big fire balls or something. Wondering how you do it."
My friend chirps in with, "That's our fire. Hehe" in cute girly mode.
Then they left......So far I havent had any trouble burning at parks here, once the park guys came out and said he can;t tell us that we can do that.

Mon, May 19, 2008 - 1:16 PMI spoke with the Captain at our local fire house, who referred me to the captain at the Fire Prevention Bureau. The local captain seemed to think it was prohibited at our location because we are in the Mountain Fire District. But the other Captain basically said any rules they have are unenforcable on private party. As I told him, I am not trying to avoid citation, I am trying to avoid having three firemen and a truck visit our house just because the neighbor is an ass.
I plan to go up to the local fire house and meet the Captain there and establish a rapport. I hope to get to a point where I can just call the fire house when we want to spin fire so that they know what we are doing. Then, when the neighbor calls, they can tell the neighbor that they are aware of it and everything is fine.
We are also working on training some vines to grow up above our fence so that the nosey neighbor can't see what we are doing. -

Thu, June 26, 2008 - 2:27 PMInteresting update...we did some fire spinning the other night and the fire dept showed up again. I told the captain about my prior conversations and he didn't think that was right. As he explained it, we are in the Mountain Fire District and that no open flame is allowed, period. According to him, that includes tiki torches and fire pits. He gave me yet another person to contact, so we are about back to square one on our saga. -

Fri, June 27, 2008 - 8:47 AMThe funny thing is that I have spoken with five captains so far and there seems to be no ultimate authority. The section of the code the last guy cited that gave them authority to tell me no was:
Sec 57.25.11. Open Flame Prohibited. There shall be no open flame or sel-contained device capable of producing flame permitted or located upon any road, street or fire road within a Mountain Fire District.
Our house is not a road, street or fire road.
Section 57.25.14 says that smoking is prohibited in the Mountain Fire District. So are they going to come tell me to put my cigarette out?
I am starting to think I need a lawyer to resolve this.
